Whilom

Terms of Use

Effective September 3, 2026

These Terms of Use (“Terms”) apply to your use of Whilom, an iOS app provided by Roman Petliakov, an individual developer (“Whilom,” “we,” “us,” or “our”). By downloading, accessing, or using Whilom, you agree to these Terms.

1. Apple Standard EULA

Your license to use Whilom is governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), which is incorporated into these Terms. These Terms supplement the Apple Standard EULA. If these Terms conflict with the Apple Standard EULA regarding your license to the app, the Apple Standard EULA controls.

2. What Whilom Does

Whilom helps you record country days, organize travel history, calculate a standard Schengen 90/180-day allowance, maintain visa countdowns and journal entries, use related widgets, and create travel reports and backups. Features can depend on the information you enter, device permissions, location availability, background execution, and Apple platform services.

A visa countdown is based only on dates and other information that you configure. It does not verify visa validity, immigration status, or a permitted period of stay.

3. Important Travel Disclaimer

Whilom is an informational record-keeping and calculation tool. It does not provide legal, immigration, tax, residency, visa, or border-entry advice. A calculation, countdown, status, projection, notification, report, or other result from Whilom is not a decision or permission from a government authority.

Travel and immigration rules can change and can depend on facts that Whilom does not know. The standard Schengen calculation does not account for every nationality, residence permit, long-stay visa, bilateral agreement, exemption, or decision by an authority. You are responsible for checking your circumstances and current official requirements with the applicable government, embassy, consulate, immigration authority, or qualified professional before making a travel or immigration decision.

4. Accuracy and Automatic Tracking

You are responsible for reviewing and correcting your travel history. Automatic tracking is provided as a convenience and is not guaranteed to detect or record every country change or day. Results can be affected by inaccurate or missing information, disabled permissions, reduced location accuracy, unavailable signals, device settings, operating-system restrictions, background execution, time-zone changes, or device failure.

We do not guarantee that any calculation, reminder, projection, report, widget, or recorded day is complete, current, or error-free.

5. Subscriptions, Free Trials, and Billing

6. Your Information, Journal, and Backups

You remain responsible for the information, notes, and photos you add to Whilom. You confirm that you have the right to use that content. You are responsible for creating backups and storing exported files safely. Removing Whilom, losing or damaging a device, failing to create a usable backup, or changing system data can result in data loss.

Exported reports and backups can contain sensitive travel information, notes, and photos. You are responsible for deciding where to save or share them.

7. Acceptable Use

You must use Whilom lawfully and in accordance with these Terms and the Apple Standard EULA. You must not interfere with the app’s operation, attempt to bypass subscription access, use the app to violate another person’s rights, or reverse engineer or redistribute the app except where applicable law expressly permits it.

8. Ownership

Whilom, including its software, design, branding, and original content, is owned by Roman Petliakov or applicable licensors. Your purchase or download gives you a limited personal license under the Apple Standard EULA. It does not transfer ownership of Whilom to you.

9. Apple and Third-Party Services

Apple is not responsible for maintaining or supporting Whilom except as stated in the Apple Standard EULA. Some functions rely on Apple or other service providers. Their availability and separate terms can affect those functions. Apple and its subsidiaries are third-party beneficiaries of the Apple Standard EULA and can enforce it.

10. Changes and Availability

We can update, change, suspend, or discontinue features when reasonably necessary, subject to applicable law and Apple’s subscription requirements. We can update these Terms by publishing a revised version with a new effective date. If applicable law requires additional notice or consent, we will provide it.

11. Disclaimers

To the maximum extent permitted by applicable law, Whilom is provided “as is” and “as available.” We disclaim warranties not expressly required by law. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Roman Petliakov is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from reliance on travel calculations, missed or inaccurate records, unavailable features, or loss of data. This limitation does not apply where liability cannot legally be limited.

13. Suspension and Termination

You can stop using Whilom at any time. We can suspend or terminate access when required by law, Apple platform rules, security needs, or a material violation of these Terms. Subscription cancellation and refund rights remain governed by Apple and applicable law.

14. Applicable Law

The governing-law provisions of the Apple Standard EULA apply to your app license. Mandatory consumer protections in your country or region continue to apply.
